The Subject or rather the authorities method of testing a seized gun raised its ugly head on BBS today.
Surely the law is exactly that,why debate the subject?.

It always amuses me when people say "they only test with the pellets you're caught with" or "I bought it as a sub 12 so it's HWs problem"

Yep, Absolute offence and its the owners responsibility! So many people have no idea this is the case and the punishments attached.

There is no set test regime within the U.K. As long as the Test House follows it's own procedure they can virtually test however they wish.
The Law does specify that the rifle/pistol should not be CAPABLE of more than 12/6 FPE (they all are).
The Law states that the "Holder" of the gun is responsible. The fitting of AT does not absolve you from this responsibility.
As said it's an Absolute offence with no requirement to prove intent, just to prove the fact that it is capable.

I've bought 3 rifles and 4 pistols over the last few years, and not once has any of the RFD's mentioned "the owners responsibility". Clearly, ignorance of the law is no excuse. So maybe the RFD should be required, if nothing else, to hand the buyer a leaflet outlining the law and his responsibilities.
